residing in portions of said district remote from the school-house in said district thereby rendering it difficult for them in inclement weather and in winter to attend school at such school-house; or by reason of the room or rooms in said school-house being overcrowded, or for any other sufficient reason the due accommodation of said children can not be made in said school-house, they may establish temporary or branch school or schools in such place or places in said district as shall best accommodate such children, and hire any room or rooms for the keeping of said temporary or branch school or schools and fit up and furnish said room or rooms in a suitable manner for conducting such school or schools therein. Any expenditure made or liability incurred in pursuance of this section shall be a charge upon the district.

§ 10. Section sixty of title seven of chapter five hundred and fifty-five of the laws of eighteen hundred and sixty-four, as amended by chapter two hundred and forty-five of the laws of eighteen hundred and eighty-nine is hereby amended to read as follows:

§ 60. The trustees of each school district shall, between the twenty-fifth day of July and the first Tuesday of August, in the year eighteen hundred and ninety-three, make to the school commissioner a report in writing, dated on the twenty-sixth day of July, and on the first day of August in each year thereafter make to the school commissioner a report in writing for the period ending with the date of such report; such report to cover the month of August in the preceding year. In every case the trustee or trustees shall sign and certify to said report and deliver it to the clerk of the town in which the school-house of the district is situated; and every such report shall certify:

1. The whole time any school has been kept in their district during the year ending on the day previous to the date of such report, and distinguishing what portion of the time such school has been kept by qualified teachers, and the whole number of days, including holidays, in which the school was taught by qualified teachers.

2. The amount of their drafts upon the supervisor or collector, for the payment of teachers' wages during such year, and the amount of their drafts upon them for the purchase of books and school apparatus during such year, and the manner in which such moneys have been expended.

3. The number of children taught in the district school or schools during such year by qualified teachers, and the sum of the days' attendance of all such children upon the school.

4. The number of children residing in the district on the thir tieth day of June previous to the making of such report, and the names of the parents or other persons with whom such children did respectively reside, and the number of children residing with each.

5. The amount of money paid for teachers' wages, in addition to the public money paid therefor, the amount of taxes levied in said district for purchasing school-house sites, for building, hiring, purchasing, repairing and insuring school-houses, for fuel, for district libraries, or for any other purpose allowed by law, and such other information in relation to the schools and the district as the superintendent of public instruction may from time to time require.

§ 11. Section five of title nine of chapter five hundred and fiftyfive of the laws of eighteen hundred and sixty-four as amended by chapter two hundred and forty-five of the laws of eighteen hundred and eighty-nine, is hereby amended to read as follows:

§ 5. Any such meeting held as aforesaid shall be organized Proceedby the appointment of a chairman and secretary, and may be meeting to adjourned from time to time by a majority vote, provided that free school. such adjournment shall not be for a longer period than ten days; and whenever any such meeting, at which not less than fifteen persons entitled to vote thereat shall, by the affirmative vote of a majority present and voting, determine to establish a union free school in said district, pursuant to such notice, it shall thereupon be lawful for such meeting to proceed to the election, by ballot, Election of of not less than three or more than nine trustees, who shall, by the order of such meeting, be divided into three several classes, the first to hold until one, the second until two, the third until three years from the fourth Tuesday in August next following, except in the cases in the next section provided for; and when the trustees so elected shall enter upon their office, the office of any existing trustee or trustees shall cease, except for the purposes stated in section eleven of title six of this act. The said Board of trustees and their successors in office shall constitute the board of education of and for the union free school district for which they are elected, and the designation of such district as union

by the school commissioner having jurisdiction of the district; and the said board shall have the name and style of the board of education of (adding the designation aforesaid); copies of said call, minutes of said meeting or meetings, duly certified by the chairman and secretary thereof, shall be by them, or either of them, transmitted and deposited, one to and with the town clerk, one to and with the school commissioner in whose jurisdiction said districts are located, and one to and with the superintendent of public instruction; but when, at any such meeting, the question as to the establishment of a union free school shall not be decided in the affirmative, as aforesaid, then all further proceedings at such meeting, except a motion to reconsider or adjourn, shall be dispensed with, and no such meeting shall be again called within one year thereafter.

§ 12. Section nine of title nine of chapter five hundred and fiftyfive of the laws of eighteen hundred and sixty-four, as amended by chapter five hundred and forty-eight of the laws of eighteen hundred and ninety, is hereby amended so as to read as follows: § 9. The annual meeting of the board of education of every union free school district shall be held on the first Tuesday of September in each year.

§ 13. Section fourteen of title nine of chapter five hundred and fifty-five of the laws of eighteen hundred and sixty-four, as amended by chapter two hundred and forty-five of the laws of eighteen hundred and eighty-nine, is hereby amended to read as follows:

§ 14. In union free school districts, other than those whose certain dis limits correspond with any city or incorporated village, the tricts, how board of education shall have power to call special meetings of the inhabitants, in the manner provided in section ten of title nine of this act, and shall, in like manner, give notice of the time and place of holding the annual school district meeting which shall be held on the fourth Tuesday of August in each year. The proceedings of no such special meeting shall be held illegal for want of a due notice to all the persons qualified to vote thereat unless it shall appear that the omission to give such notice was willful and fraudulent.

§ 14. This act shall take effect immediately.
